USE OF THE APP

By using the emaho web app, you agree to be bound by the following Terms of use. The App is owned and operated by emaho and reserves the right to modify or change the Terms of use at any time and without prior notice. Your continued use of the App constitutes your acceptance of such changes.

ACCEPTANCE OF TERMS

The App is designed to enhance your digital environment. By using the App, you agree to comply with all applicable laws and regulations. If these terms of use are in conflict with your local laws, you may not use the app.

FOREWORD

The words "The Company" and "emaho" will be used interchangeably throughout this document, but both always refer to the company emaho, including its products, services, and operations. These terms represent the entity responsible for providing the emaho app and related services. When you see either of these terms, they should be understood as referring to the same organization, its policies, and the manner in which it operates its platform. This clarification ensures that there is no confusion about which entity is being referred to in the context of the terms and conditions, privacy policy, and other legal agreements associated with the use of the app. When “The App” is mentioned we refer to the emaho web app.

This privacy policy describes how we collect, use, and protect the personal information of users of our web app.

INFORMATION WE COLLECT

We collect the following types of information: your email address, first name, last name and organization name. We also collect the data you provide when you participate in a questionnaire. Your data is stored in and encrypted in the database at volume (disk) level. We collect analytics data, including user navigation patterns, time spent on screens, geographic location (country), and in-app interactions. This information helps us understand how users engage with the web app, allowing us to improve its functionality and enhance the overall user experience. The data we collect is solely functional or for the purpose of improving the experience of the app.

HOW WE USE YOUR INFORMATION

We use your personal information to: Create and manage your account. Provide the App's features and functionality. Send you important email notifications related to the App. Analyze and improve the App's performance and user experience. We will not sell, rent, or lease your personal information to third parties. In the emaho app we use AI models from OpenAI. To ensure the data provided to the model is free of personal information, we avoid including names in the prompts. Instead, we use a random token linked to a specific individual, keeping the model unaware of any personal identifiers like names. We may process information to for security, fraud prevention and to comply with law. The analytics data gathered includes, but is not limited to: Routing information to understand the navigation patterns; Time on screen; Country from which request is made; Interactivity in the app; These insights help us understand user behavior without identifying specific individuals. Your privacy is important to us, and the collected data is used solely for internal improvements.

HOW WE PROTECT YOUR INFORMATION

We use commercially reasonable security measures to protect your personal information from unauthorized access, disclosure, or modification. When you delete your account, your data is removed from the database immediately, we will only keep data if required by law. If you notice any incorrect information in your account or preferences, please contact us immediately, and we will update it. We will keep a backup of the data for a maximum of 3 months.

WEB ANALYTICS AND COOKIES

Our Web Analytics tool collects only anonymized, aggregated data, adhering to leading data protection authority guidelines. No personal identifiers are tracked across different sites or applications. Data points like page views and custom events remain anonymous, providing insights without individual or IP address association. We do not store information enabling user session reconstruction or personal identification. The collected data is strictly used for aggregated statistics. We only use cookies for functional purposes.

THIRD PARTIES

We utilize third-party services to provide and enhance the functionality and security of our application. These third parties have only limited access to your information, may use your information only to perform tasks on our behalf. emaho is not responsible for any breach or leakage of data from a third party. Some of the third-party services we use are: Supabase, Powersync, Vercel, Google Gemini, and OpenAI. By using the emaho app, you acknowledge and agree that your data may be shared with these third-party services as described in our privacy policy. We remain committed to protecting your information and take all reasonable steps to ensure that third-party providers uphold the necessary security and privacy standards.

DO WE COLLECT DATA FROM MINORS?

emaho is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from users in this age group. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us at legal@emaho.world, and we will take steps to remove that information from our servers.

(USER) GENERATED CONTENT

The App allows you to get a profile based on your personality type that results from the questionnaires you complete, we intend to generate this profile as accurately as possible but there may be some incorrect information to it. Always make sure to discern for yourself if the information is relevant to you. When using any of the AI chat functions in the app, make sure to always to research and discern the response you get for yourself. You may not send out prompt to the AI chat that obtain harmful language or intend to use the AI chat for something abusive or harmful. The AI features where there are multiple people involved have a purpose to improve collaboration and be more educated about each other. The results are just an estimation of the personality and do not ensure that the involved people are that way. To ensure the data provided to the model is free of personal information, we avoid including names in the prompts. Instead, we use a random token linked to a specific individual, keeping the model unaware of any personal identifiers like names. You may never use the group AI functionality to cause malice or harm to the person. You can save parts of the content useful to you in your key insights. The AI chat content are lost once you close the chat. This is content that will be stored within your account and you can take this content and use it wherever you want. The Company reserves the right to moderate or remove any content that violates these Terms of use, or that the Company deems inappropriate or offensive. The Company is not responsible for any damages that may arise from the content and ideas obtained by users on the App. You agree to use the App in a responsible and respectful manner and to refrain from posting any content that is illegal, offensive, defamatory, or infringes upon the rights of any third party. The Company reserves the right to terminate your access to the App and take further steps if you violate these terms.

OWNERSHIP OF CONTENT

Except for generated content output as described above, all intellectual property rights in the App and its content belong to the Company. You may not use, copy, reproduce, or distribute any part of the app.

GDPR

We are committed to protecting your personal data and ensuring your privacy rights are respected. In accordance with the General Data Protection Regulation (GDPR), we process your data lawfully, fairly, and transparently. We collect and use your data only for specific, legitimate purposes and ensure its accuracy. You have the right to access, correct, or delete your personal data, as well as restrict its processing and request its portability. We also provide you with the option to object to processing based on legitimate interests or for direct marketing purposes. ACCOUNT ACCESS

Users can sign in to their account using their email address. It is the responsibility of to choose a safe email provider, have a secure password and potential multi-factor authentication. If access to your email has been compromised, it is possible to enter the emaho app. We are not responsible if someone gets access to emaho in this way, this includes if they share the content that is present in your account.

DISCLAIMER

The App is provided on an "as is" basis. The Company does not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components. The Company is not responsible for any damages that may arise from the use of the App. We are continually working to improve the app and minimize the potential for errors and other issues. However, we cannot guarantee that all issues will be resolved or that the app will be completely error-free. If you encounter any problems while using the app, please let us know so we can investigate and address the issue. Users acknowledge and accept the risks and limitations associated with using the app. emaho is not responsible for any loss or leakage of data. By using the app, you acknowledge and accept the risks and limitations associated with using it. If you do not agree with the terms of this disclaimer, do not use the app.

GENERATE CONTENT WITH AI

On emaho web there is a possibility to generate content with AI. You should not assume that the correct content is always returned. The content returned will be based on the involved personality types, the input provided and the context that we as emaho add. If you spam this functionality, you may not be able to use it for a indefinite time.

MODIFICATION

We have the right to fix, change features or update information at anytime; We may experiment with new prompts, which might change the output you will see on your screen from time to time; We may shut down the app immediately if there is a significant cyber security risk; We may remove users from the app, who are abusing the system in a harmful way;

PROHIBITS

You may not access emaho through automated means, whether it be a bot, script or otherwise; You will not use the app for any illegal or unauthorized purpose; You may not use information obtained from our App to attack or abuse another person; You may not intimidate, annoy or threaten any of the Employees of emaho while communicating with us; You may not copy the software; You may not misuse or exploit any features or functionalities for purposes other than their intended use; You may not spam the app with content; Users are expected to engage with the app respectfully and responsibly, adhering to any community guidelines or codes of conduct established by emaho. This includes refraining from use that is illegal, offensive, defamatory, or infringes upon the rights of others.

TERMINATION

emaho reserves the right to terminate your access to the App at any time and without prior notice.

NO DECOMPILATION OR REVERSE ENGINEERING

You agree not to decompile, reverse engineer, modify, or attempt to copy the app.

LIMITATION OF LIABILITY

The Company will not be liable for any damages arising from the use of the App or the inability to use the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages, personal injury or loss of privacy. Our liability to you will at all times be limited to the amount paid, if any, by you to us during the 6 month period prior to any cause of action arising. We have the right to take (legal) action if we deem that the terms of use have been violated. If these terms of use have any conflict with your local law, you may not use the app. We are not responsible for the consequences or liable in any way if you still choose to use the app when there are conflicts with your local law.

GOVERNING LAW

These Terms of Use are governed by and construed in accordance with the laws of The Netherlands. Any disputes arising from the use of the App shall be resolved exclusively by the courts located in 's-Hertogenbosch, The Netherlands. You agree to submit to the personal jurisdiction of these courts for the purpose of litigating all such disputes. In the event of any dispute or claim arising from or related to the use of the App, you agree to first attempt to resolve the dispute informally by contacting us directly. If we are unable to resolve the dispute informally, then the dispute shall be resolved exclusively by arbitration in accordance with the rules of the Netherlands Arbitration Institute (NAI). The arbitration shall be conducted in 's-Hertogenbosch, The Netherlands, and the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. By using the App, you consent to the exclusive jurisdiction of the courts located in 's-Hertogenbosch, The Netherlands, and agree to waive any objection to such jurisdiction or venue.
